Prize Terms and Conditions
Introduction
Information on how to enter forms part of these terms and conditions. Entry into any Ten Days on the Island promotion is deemed acceptance of these terms and conditions. Headings are for reference only and do not affect interpretation.
Eligibility
Entry is open to all Australian residents (Eligible Entrants), excluding directors, management, employees and their immediate families of Ten Days on the Island. If a prize winner is under 18, they must obtain parental or legal guardian consent to redeem their prize, and may be required to be accompanied by an adult Australian or New Zealand resident.
Entry
To enter, Eligible Entrants must follow the instructions provided for each specific promotion during the stated Promotion Period.
Ten Days on the Island is not responsible for any lost, late or misdirected entries.
Eligible Entrants may enter multiple times, unless otherwise stated.
The time of entry will be deemed to be the time the entry is received by Ten Days on the Island.
Ten Days on the Island reserves the right to verify the validity of entries and Eligible Entrants (including identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure to enforce any rights at any stage does not constitute a waiver of those rights.
Judging and Draws
Unless otherwise stated, entries will be drawn randomly. For games of skill, entries will be judged on merit.
Prize draws will be conducted at the offices of Ten Days on the Island within seven days of the campaign close.
The decision is final and no correspondence will be entered into.
Prizes
Prizes include GST and any applicable taxes. Compliance with health or other government requirements is the responsibility of the prize-winner and companion. Ten Days on the Island accepts no responsibility for safety, conditions, cancellations or other issues in accepting the prize.
Prizes are not transferable, changeable or redeemable for cash unless otherwise stated. Accommodation prizes are valid for the exact dates noted in the competition information only and are not changeable or transferable.
Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed by Ten Days on the Island. Acceptance of a prize is subject to the conditions of use of that prize.
Notification and Privacy
Winners will be notified via email or phone call. Winners will not be publicly announced unless explicit consent is given. The name and photograph of the winner may be used for promotional purposes only with the winner’s consent.
Ten Days on the Island reserves the right to redraw in the event of an entrant being unable to satisfy these terms and conditions or forfeiting/not claiming a prize. For any prize that remains unclaimed, a second draw will be conducted at the same place as the original judging, subject to any written direction under applicable law. Any winners determined in accordance with this clause will be notified via email or phone call.
Limitation of Liability and Variation
If any act, omission, event or circumstance occurs beyond the reasonable control of Ten Days on the Island which prevents compliance with these terms and conditions, Ten Days on the Island will not be liable for any failure to perform or delay in performing its obligations and reserves the right (subject to applicable law) to cancel, terminate, modify or suspend the promotion.
Ten Days on the Island, its related bodies corporate and their respective officers, employees, contractors and agents will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy whatsoever, including direct, indirect and consequential damages.
The exclusion of liability above does not apply to limit or exclude liability:
- for personal injury or death suffered or sustained in connection with the supply of goods or services supplied by the Promoter in the ordinary course of business; or
- to the extent it is not permissible at law to limit or exclude liability in the manner contemplated (in which case liability is limited to the maximum extent allowable by law).
Entry Details and Privacy
Entry details remain the property of Ten Days on the Island. Personal information provided in connection with this promotion will be used for the purposes of facilitating the conduct of the promotion and awarding prizes (including to third parties involved in the promotion and any applicable statutory authorities) and to conduct marketing activities, in accordance with the Ten Days on the Island Privacy Policy.
Tax Implications
Ten Days on the Island accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
Social Media Platforms
Promotions run on Facebook, Instagram or other social media platforms are in no way sponsored, endorsed or administered by, or associated with those platforms. Entrants understand and agree that they are providing their information to Ten Days on the Island and not to the social media platform. By entering, each Eligible Entrant releases the platform from any action or claim arising out of the competition. Any questions, comments or complaints regarding the competition must be directed to Ten Days on the Island, not the platform.
At all times, Eligible Entrants agree to act in accordance with the relevant platform’s terms of use and policies.
Compliance
All prize draws and competitions are conducted in accordance with Tasmanian law, including the Gaming Control Act 1993 and relevant trade promotion lottery rules. No permit is required for prize draws where the total prize value is under $10,000 and no cash prize exceeds $5,000.
General
By entering, entrants accept these terms and conditions. Ten Days on the Island reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or breaches these terms.
The Promoter may update these terms and conditions from time to time. The latest version will always be available at www.tendays.org.au/terms-and-conditions.
